KEPASTIAN HUKUM PEMENUHAN SEDIAAN FARMASI DALAM PELAYANAN KESEHATAN TERHADAP PASIEN PADA RUMAH SAKIT

Abstract: The fulfillment of pharmaceutical supplies is a primary pillar in the implementation of hospital health services, directly impacting patient safety. However, irregularities in the availability of medicines and medical devices often hinder the fulfillment of citizens' constitutional rights to health. This study aims to analyze the urgency of legal certainty in providing pharmaceutical supplies in hospitals and the form of legal liability of hospitals in guaranteeing such availability according to pharmaceutical service standards. The research method used is normative legal research with statutory and conceptual approaches. The results indicate that legal certainty in the fulfillment of pharmaceutical supplies stems not only from the administrative aspects of health regulations but also from the protection of patient rights as health service consumers. In conclusion, strengthening regulations and synchronizing pharmaceutical service standards are essential to minimize drug vacancies that potentially violate patients' human rights. Abstrak: Pemenuhan sediaan farmasi merupakan pilar utama dalam penyelenggaraan pelayanan kesehatan di rumah sakit yang berdampak langsung pada keselamatan pasien (patient safety). Namun, ketidakteraturan ketersediaan obat dan alat kesehatan seringkali menjadi hambatan dalam pemenuhan hak konstitusional warga negara atas kesehatan. Penelitian ini bertujuan untuk menganalisis urgensi kepastian hukum dalam penyediaan sediaan farmasi di rumah sakit dan bentuk pertanggungjawaban hukum pihak rumah sakit dalam menjamin ketersediaan tersebut sesuai standar pelayanan kefarmasian. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa kepastian hukum dalam pemenuhan sediaan farmasi tidak hanya bersumber pada aspek administratif regulasi kesehatan, tetapi juga pada perlindungan hak pasien sebagai konsumen jasa kesehatan. Kesimpulannya, penguatan regulasi dan sinkronisasi standar pelayanan kefarmasian sangat diperlukan guna meminimalisir kekosongan stok obat yang berpotensi melanggar hak asasi pasien.
